or direction in the nature of writ, calling for the records relating with the order of the 4th respondent made in Na.Ka.No M1 / ACR 171 / 2023 dated 11.12.2023 and in Ma.Aa.No.1261/2023 and quash the same as it is arbitrary and illegal and in consequence direct the respondents to restore the pay and to accordingly re fix the pension in accordance with the last drawn pay while in service and to pay the arrears of pension and to repay the recovered amount of Rs.2,25,780 deducted from the petitioners gratuity in the light of the order passed by the Hon'ble Supreme Court in Whitewasher case reported in 2015 (4) SCC 334 within the time limit. When the matter came up for hearing, the learned Additional Government Pleader, appearing on behalf of respondents 1, 3 and 4, upon instructions, submitted that the petitioner has remitted the recovery amount as demanded in the impugned recovery proceedings dated 11.12.2023. In this regard, an e-challan has also been filed along with the writ petition. Therefore, nothing survives for further adjudication in the present writ petition.

2. Recording the said submission, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, the connected miscellaneous petition is closed.
