: Respondents PRAYER: Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the respondents to permit to conduct the Sri Krishnar Temple Avani Festival in connection with Vada Maadu Manchu Virattu scheduled on 02.09.2018 at Periya Kiluvachi Village, Kalaiyarkovil Taluk, Sivagangai District by considering the petitioner's representation dated 11.08.2018. O R D E R

This Writ Petition has been filed for a direction to the respondents to permit the petitioner to conduct Vada Maadu Manchu Virattu at Sri Krishnar Temple in connection with the Avani Festival. The representations dated 22.07.2018 and 11.08.2018 have been made to the respondents in this regard. Since no orders have been passed, the present writ petition has been filed. 2.The learned Counsel for the petitioner would submit that for the last four years this festival has been conducted and adequate protection was also given by the third respondent. 3.The learned Government Advocate would submit that no law and order problem was created during the previous years and the festival went on smoothly.

4.Taking into consideration the previous conduct of the petitioner and also the fact that this festival has been conducted for the past four years without any law and order problem, the first respondent is directed to consider the representations of the petitioner dated 22.07.2018 and 11.08.2018 and grant permission for conducting the Vada Maadu Manchu Virattu on 02.09.2018, with the following conditions:

"(i)The petitioner should specifically undertake that Vada Maadu Manchu Virattu shall be conducted without indulging in unlawful activities like gambling, etc.

(ii)The petitioner should also satisfy the first respondent that they will provide emergency medical aid both to the animals and persons, who participate in Vada Maadu Manchu Virattu. It is made clear that such facilities should be provided at the cost of the petitioner.

(iii)The participants should not involve in any harassment towards the animals."

5.The respondents are directed to ensure that the above said conditions are complied with scrupulously and the entire event goes on smoothly without giving rise to any law and order problem. 6.The Writ Petition is disposed of, with the above direction. No costs.
