Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to give police protection and necessary permission for conducting the Temple festive for Sri Arulmighu Mutharamman, Sri Arulmighu Muppidathi Amman Temple, Thanakkarkulam Village, Radhapuram Taluk, Tirunelveli District to be held on 3rd to 5th July, 2017.

[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondent to give police protection on the eve of Temple festival mentioned in the petition, by way of issuing a Writ of Mandamus. 2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for the respondent. 3.The learned counsel appearing for the petitioner has advanced his argument on the basis of averments made in the petition.

4.The learned Additional Government Pleader appearing for the respondent has contended to the effect that one Kaliappan has filed Writ Petition(MD)No.11599 of 2017, wherein a specific direction has been given to the respondent to consider the representation alleged to have been given by the petitioner and accordingly, a Peace Committee Meeting has been convened by the concerned Deputy Superintendent of Police, wherein no possible https://hcservices.ecourts.gov.in/hcservices/

effects have been done. Under the said circumstances, the relief sought in the Writ Petition cannot be granted. 5.Considering the fact that already Writ Petition(MD) No.11599 of 2017 has been filed wherein a specific direction has been given to consider the representation and accordingly Peace Committee Meeting has been convened by the concerned Deputy Superintendent of Police and the same has been failed, the relief sought in the Writ Petition cannot be granted and therefore the same deserves to be dismissed.
