ORDER : The Court made the following order :- The petitioner is facing charges under Sections 420 and 506(i) IPC in Crime No.Not known of 2022 on the file of the respondent police.

2.The learned Additional Public Prosecutor (Crl. Side) for the respondent submitted that on the basis of the complaint given by one Mohan, enquiry was undertaken. During the course of enquiry, the petitioner did not appear and the complainant appeared. The defacto complainant alleged to have stated that since the petitioner has filed a petition before this Court, he will workout his remedy before this Court.

3.Such sort of attitude cannot be encouraged. When a complaint has been given, the petitioner has to appear before the Enquiry Officer or before the Investigation Officer, as the case may be, without fail. After filing of this petition, the petitioner refused to appear before the Enquiry Officer.

CRL OP(MD). No.11353 of 2022 4.Since no case has been registered against the petitioner so far, this petition is dismissed. Of course, if any further complaint is given or if any trouble arises during the course of enquiry, the petitioner can workout her remedy through appropriate proceedings. 5.With the aforesaid liberty, this Criminal Original Petition is dismissed.
