Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent herein to dispose the petitioner's appeal dated 22.06.2016 which was preferred challenging the order of punishment of stoppage of increment for a period of three years with cumulative effect imposed by the 2nd respondent vide his proceedings in Ref:LD1D1:639, dated 24.05.2016 within the time stipulated by this Court.

The petitioner has come up with this writ petition seeking a direction, directing the first respondent to dispose the petitioner's appeal dated 22.06.2016 which was preferred challenging the order of punishment of stoppage of increment for a period of three years with cumulative effect imposed by the second respondent vide his proceedings in Ref:LD1D1:639, dated 24.05.2016 within the time stipulated by this Court.

2.Heard Mr.J.Lawrance, learned counsel appearing for the petitioner and Mr.R.Karthikeyan, learned Additional Government Pleader appearing for the respondents.

3.The learned counsel appearing for the petitioner submitted that the petitioner preferred an appeal on 22.06.2016 challenging the order of the second respondent dated 24.05.2016, vide his proceedings in Ref:LD1D1:639, is pending for quite long time. Therefore, suitable direction may be given to the first respondent to dispose of the pending appeal.

4.The learned Additional Government Pleader appearing for the respondents submitted that the appeal is pending before the first respondent.

5.In view of the said submissions, this Court finds no impediment to direct the first respondent to dispose of the pending appeal.

6.Without going into the merits of the case, this Court directs the first respondent to dispose the petitioner's appeal dated 22.06.2016 on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order. No costs.
