Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus, calling for the records in relating to the impugned Refusal Number RFL/Thiruverumbur/19/2025 dated 27.01.2025 passed by the 2nd respondent and quash the same as illegal and consequently direct the 2nd respondent herein to register the sale deed dated 27.01.2025 within a stipulated period fixed by this Court. ORDER

The Writ Petition is filed challenging the impugned refusal check slip in RFL/Thiruverumbur/19/2025 dated 27.01.2025 passed by the second respondent and consequently, to direct the second respondent herein to register the sale deed dated 27.01.2025 within a stipulated period fixed by this Court.

2. The ground for refusal of of the document is that the registration of this document might result in double entry.

3. This issue is no longer res integra. It has been settled by a judgment of this Court in T.Senthilvel Vs. The District Registrar (Administration), Dindigul District and another, W.P.(MD).No.22114 of 2024 dated 17.10.2024. The learned Judge had specifically held that the fact that there will be a double entry of a document is not a ground for a Sub Registrar to refuse registration.

4. Following the said judgment, the impugned order is quashed. There shall be a direction to the second respondent to register the sale deed presented by the petitioner dated 27.01.2025, if it is otherwise in order. Needless to add, in case the vendor of the property has no title to the property, by virtue of registration, the purchaser will not get any title to the same.

5. Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
