Prayer: Writ Petition is filed under Article 226 of the Constitution of India, in the nature of a Writ of Mandamus, directing the second respondent to considering the representation dated 12.03.2025 of the petitioner and 1/4

regularize the service of the petitioner either from the date of appointment i.e, from 01.02.2001 or on completion of 240 days of continuous service without break i.e, from 29.09.2001, so as to enable the petitioner to get pensionary benefits under Old Pension Scheme. Heard, the learned Counsel for the petitioner, learned Standing Counsel for the respondent and perused the materials available on record.

2. The case of the petitioner is that he is working as Conductor in the respondent transport corporation and he was appointed in the year 2001. But his service was regularized with effect from the year 2005. Requesting to regularize the service from the date of new appointment, the petitioner submitted a representation to the respondents on 29.11.2012 and presently on 12.03.2025. Against the inaction of the respondents not in not considering his representations, the present writ petition is filed.

3. During the course of hearing, the learned Counsel for the petitioner confined his relief seeking direction of disposal of the representations by the respondents in accordance with law.

Considering the request of the learned Counsel for the petitioner, in our considered view, without going into the merits of the case, this writ petition can be disposed of at the admission stage with the consent of both sides with a direction to the respondents to consider the representations of the petitioner within a time limit to be stipulated herein. 5.Accordingly, this writ petition is disposed of, with the following directions:

i) The respondents are directed to consider the representations submitted by the petitioner for regularization of his service with effect from the date of his initial appointment and pass appropriate orders by following due process of law within a period of four weeks from the date of receipt of a copy of this order.

There shall be no order as to costs.
