PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents 1 and 2 to secure the petitioner's wife, namely, Chandralekha, W/o.Rajkumar, aged about 32 years and daughter, Keethika, D/o.Rajkumar, aged about 5 years and produce them or their body or corpus before this Court and set them at liberty.

O R D E R

(Order of the Court was made by R.SURESH KUMAR, J.) This Habeas Corpus Petition has been filed to direct the respondents 1 and 2 to produce the petitioner's wife, namely, Chandralekha, aged about 32 years and his daughter, namely, Keerthika, aged about 5 years before this Court and set them at liberty.

2. The first detenue, namely, Chandralekha and the second detenue/child, namely, Keerthika, have been produced before this Court by the respondent Police.

3. The first detenue has stated that she had been along with the second detenue in Chennai for some time at a relative's house. Due to some strained relationship between the first detenue and the petitioner, who is the husband of the first detenue, she had left the matrimonial home and was taking shelter in the relative's house.

4. Now, she has come back with the child to her parents and she would further submit that she along with her child want to go with her parents at least for the time being and thereafter, if the situation improves to defuse the strained relationship between the first detenue and the petitioner, she may think of returning back to the matrimonial home.

5. The said submission made by the first detenue is recorded.

6. In view of the same, since the detenues are not in illegal custody at the hands of anyone, recording the same, this Habeas Corpus Petition is closed.
