PRAYER :- For Bail in Crime No.186 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 30.05.2022 for the offence under section 328 IPC r/w Sections 8(c) r/w 20(b)(ii)(B), 25 of NDPS Act in Crime No.186 of 2022 on the file of the respondent police seeks bail. 2.The case of the prosecution is that on 30.05.2022, when the police party conducted raid, they stopped one auto and on search, it was found that the accused persons were in illegal possession of 22 kgs of ganja. Hence the case.

CRL OP(MD)No.8924 of 2023 4.It is seen that there are totally 3 accused in this case, in which, the petitioner is arrayed as A1. The petitioner along with other accused were found in possession of 22 kgs of ganja, which is commercial quantity. That apart, the petitioner is having 20 previous cases, which are all similar in nature. Hence, the petitioner failed to satisfy the twin conditions as contemplated under Section 37 of NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
