PRAYER :- For Bail in Crime No.10 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ sole accused, who was arrested and remanded judicial custody on 29.04.2023 for the offences punishable under Sections 452, 341, 376, 294(b), 506(i) of IPC in Crime No.10 of 2023, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner on false promise of marrying the victim had sexual intercourse with her and thereafter refused to marry her, hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and due to previous enmity a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 29.04.2023, hence he seeks bail https://www.mhc.tn.gov.in/judis 1/2

4. The learned Additional Public Prosecutor opposing the bail petition would submit that the victim is a widow and now she is five months pregnant.

5. Even according to the case of prosecution the victim lady is in family way and if the petitioner is released on bail there is a possibility of abscondance. Taking into consideration the nature and gravity of offence committed by the petitioner and also the fact that the investigation is in nascent stage, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
