PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 herein to remove the petitioner's name from History Sheet record in H.S.No.5 of 2022 on the file of the 3rd respondent police station as per petitioner's representation dated 24.04.2025 within a time stipulated by this Court. The petitioner claiming to be a Co-ordinator of a Political Party has approached this Court, seeking a relief to remove his name from the History sheet record in H.S.No.5 of 2022, on the file of the third respondent police station, by considering his representation.
2.The respondent police has registered a history sheet record in HS.No.5 of 2022 as against this petitioner on the recommendations of the Inspector of Police, Kulithalai Police Station to the Deputy Superintendent of Police in the month of June -2022 that the petitioner has involved in the following cases:- Sl.No District Crime No.

3.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) submits that since this petitioner has involved in several cases and in order to monitor the petitioner and to prevent him from involving in any further offence, they have opened the above history sheet as against this petitioner and they have periodically monitored his activities. It is only to track his behaviour due to his involvement in several cases as stated above and not otherwise.
4.This Court considered the rival submissions made and also perused the materials placed on record.
5. Police Standing Orders 748 enable the police officers to open history sheet to monitor the behaviour of the habitual offenders, in order to prevent them from involving in further offence. The procedures have also been prescribed in the Police Standing Orders that the history sheet, if any opened, has to be periodically reviewed two years after registration of History sheet and annually thereafter. The responsibility of protecting law and 4/8
order vests with the police Department. The Department, with a limited force is expected to maintain law and order of this huge population of 7 Crores of people in the State of Tamil Nadu. Therefore, opening and maintaining history sheet is a type of record maintained by the police officers as against the habitual offenders, as provided under the Police Standing Orders 748 and therefore, the respondent police cannot be found fault with for the maintenance of history sheet of this petitioner, who has involved in 21 criminal cases.
6.Though the petitioner claims that the case registered as against him is for public agitation, it appears that he has also involved in IPC offences. Though certain cases are registered for the offence under the Tamil Nadu Open Places (Prevention of Disfigurement)Act, 1959, he is also an accused in a case of attempt to murder. Apart from the cases as stated above, two other cases have been registered under the Arms Act. However, it appears that no cases have been registered as against this petitioner in the year 2024 and 2025. As per the procedure laid down in the Police 5/8
Standing Orders, the history sheet, if any opened as against the accused persons, has to be reviewed periodically, after two years of opening the history sheet and thereafter annually. 7.In view of the above, the respondent police shall review the case of this petitioner in H.S.No.5 of 2022, by considering his representation and also by considering his conduct that he has not involved in any offence in the year 2024-2025 and take a decision, within a period of two months from the date of receipt of a copy of this order. No costs.
