O R D E R

This Criminal Miscellaneous Petition is filed to suspend the sentence imposed in Spl.S.C.No.1 of 2017, dated 11.03.2022, by the Special Court for Exclusive trial of POCSO Act cases, Virudhunagar District at Srivilliputhur and to enlarge the petitioner on bail.

2. This is the third application filed for grant of suspension of sentence. This Court vide earlier orders dated 20.10.2022 and 24.04.2023 dismissed the applications for suspension of sentence. There is no change in circumstances.

3. This Court has also perused the evidence of the Doctor PW16, who noticed several injuries on the victim girl, aged about 15 years. Considering the age of the victim girl and the materials available as against this petitioner, this Court is not inclined to grant suspension of sentence. Hence, this Criminal Miscellaneous Petition is dismissed.

4. It is reported that the petitioner is in jail for 4 1/2 years. Typed set of papers is made ready. Therefore, Registry is directed to list 2/4

the main appeal for final disposal under the caption 'accused in jail cases' in the usual course.
