PRAYER :- For Bail in Crime No.28 of 2023 on the file of the Respondent Police, ORDER : The Court made the following order :- The petitioner/ A1, who was arrested and remanded judicial custody on 05.03.2023 for the offences punishable under Sections 174 Cr.P.C(Suspicious death) @ 302 and 201 of IPC in Crime No.28 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that A1 suspecting the fidelity of the deceased on 02.03.2023 he along with other accused committed the murder of the deceased by strangulating her neck with rope, hence the case.
3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submits that the petitioner is in judicial custody from 05.03.2023, hence he seeks bail.
4.The learned Additional Public Prosecutor would submit that all the accused persons strangulated the deceased and murdered her. hence he objected to grant bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.9059 of 2023 5.Taking into consideration the gravity of offence and also taking note of the fact that the deceased was brutally murdered by strangulation and also the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
6. Hence the petition stands dismissed.
