ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for 1/3

the alleged offence punishable under Sections 406, 420, 294(b) and 506(i) IPC in Crime No.471 of 2023 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioners herein received a sum of Rs.7,00,000/- from the defacto complainant on the promise of securing Government job. Thereafter, they failed to do so. Therefore, the defacto complainant demanded to return the money. The accused persons returned a sum of Rs.2,00,000/- but failed to repay the remaining amount and they have criminally intimidated the defacto complainant. Hence, the case.

3.The learned counsel appearing for the petitioners submits that the petitioners are innocents persons and they did not commit any offence as alleged by the prosecution.

4.The learned Government Advocate(Crl.side) appearing for the respondent Police submits that this is the second petition for anticipatory bail. In the earlier petition, the accused undertook to deposit a sum of Rs.2,00,000/- but failed to do so. Thereafter, extension of time petition was filed and the same was allowed on 10.04.2024. Again the petitioners failed to comply with the earlier order and filed a petition for extension of time and the same was dismissed on 04.06.2024. Even thereafter, the petitioners have not chosen to deposit the above said amount and filed 2/3

the present petition seeking anticipatory bail. Accordingly, he prays to dismiss the present petition.

5.Considering the nature of offence and the conduct of the petitioners in availing anticipatory bail by undertaking to deposit a sum of Rs.2,00,000/- and thereafter, failing to do so, this Court is not inclined to grant anticipatory bail to the petitioners.
