PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the 1st respondent to transfer the investigation in Crime No.390 of 2025 from the file of the 2nd respondent to some other investigation agency, based on the petitioner's representation dated 24.09.2025. ORDER

The present petition has been filed by the defacto complainant in Crime No.390 of 2025, on the file of the second respondent police seeking to transfer the investigation which was registered under Section 309(4) and 311 of BNS, 2023.

2. According to the learned Counsel for the petitioner, some unknown persons have committed theft of gold jewellery and there is no progress in the investigation.

3. The learned Counsel for State of TN(crl.side) appearing for the respondents submitted that A2 was a bike rider and A1 was a pillion rider and A2 was arrested immediately and A1 was arrested in a different case in Crime No.228 of 2025, on the file of the Kenikarai Police Station. He had confessed to the offence committed by him in Crime No.390 of 2025 also and therefore, the jewelleries have been recovered by way of gold bar and therefore, there is progress in the investigation and they would file a charge sheet within a period of one month from the date of receipt of a copy of this order. 2/4

4. Considering the above said facts, the question of transferring the investigation from the second respondent to any other agency does not arise. There shall be a direction to the second respondent police to file a final report on or before 31.07.2026.

5. With the above said observations, this Criminal Original Petition stands disposed of.
