PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to conclude the inquiry by considering the petitioner representation dated 20.02.2022 within the time stipulated as prescribed by this Court.

O R D E R

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the second respondent to conclude the inquiry by considering the petitioner representation, dated 20.02.2022, within the time stipulated as prescribed by this Court.

2. The case of the prosecution is that the petitioner used to visit our garden daily and on 20.02.2022 at about 8.00 a.m when he was returning from his garden, the accused persons had waylaid him, restrained him from moving further. When he questioned about the same, they had degraded his communal status and threatened him not to disclose their illegal sand mining in Odai. In this regard, the petitioner gave a complaint to the second respondent police, since it has not been considered, the present Writ Petition has been filed. 3.When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents submitted that based on the complaint given by the complainant, a case was registered in CSR No. 102 of 2022 and an enquiry was conducted 2/5

and therefore, he seeks two weeks time to complete the enquiry and also seeks a direction to the petitioner.

4. Considering the facts and circumstances of the case, the second respondent police is directed to complete the enquiry, to take suitable action on the complaint given by the petitioner, dated 20.02.2022, and pass orders on merits in accordance with law within a period of two weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate for enquiry.

5. With the above direction, this Writ Petition is disposed of. No costs.
