ORDER
This criminal original petition has been filed seeking direction to the I Additional District Court cum P.C.R Court, Trichy to consider of the bail application on the surrender of the Petitioners in connection with case in Crime No.59 of 2023, pending investigation on the file of the 2nd Respondent Police on merits on the same day.
2.The petitioner is the sole accused in Crime NO.59 of 2023 on the file of the second respondent police for the offence punishable under Sections 171(G), 193, 465, 466, 468, 471 of IPC and Section 3(1)(q) of Schedule Caste and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015.
3.The allegation against this petitioner is that she has obtained 2/5
Certificate under the SC/ST category by giving false information or misrepresentation for the purpose of contesting local body election which was conducted in 2019. Now the present complaint has been filed by opposite party making the above said allegation. According to her, even as per the allegations the Sections 461, 472 are not attracted. But, however, considering the seriousness of the allegation, this Court is not inclined to grant the relief as requested by the petitioner. The petitioner has to workout her remedy before the Court, where the matter is pending. 4.With the above said directions, this criminal original petition stands dismissed.
