Criminal Appeal filed under Section 14-A(2) of Schedule Caste and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015, as against the order of dismissal passed by the learned Judge, Special Court for Exclusive trial of cases under SC/ST (POA) Act, Thoothukudi (FAC) in Cr.MP.No.40 of 2025 in Crime No.270 of 2023, dated 06.03.2025.
ORDER: This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.J.Joseph Zinoson, Advocate for the Petitioner and of Mr. A.Albert James, Government Advocate(Criminal Side) for the 1st and 2nd respondents, this Court made the following order: This petition has been filed to relax the condition imposed on the petitioner in Crl.A(MD)No. 365 of 2025 dated 26.03.2025.
2. Mr.A.Albert James, learned Government Advocate (Crl. Side) appearing for R1 and R2 submitted that the investigation is over, charge sheet has been filed and 2/4
that has been taken on file in S.C.No.19 of 2024 by the learned PCR Court, Thoothukudi and the same is posted to 08.07.2025 for trial.
3. It is reported that the petitioner is complying the conditions without any default.
4. Considering the changes in circumstances and the fact that the case is posted for trial on 08.07.2025, the condition No.9(iii) imposed by this Court in Crl.A(MD) No.365 of 2025 dated 26.03.2025 is relaxed. However, it is made clear that the petitioner should not take advantage of this order and omit to appear for trial whenever the case is posted for trial.
