Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 3rd respondent to take action to remove the encroachment of the 5th and 6th respondents on the public pathway of 3rd respondent in TS No 368 based on the petitioner's representation to the 3rd respondent dated 10.05.2017.

O R D E R

************ [Order of the Court was made by G.R.SWAMINATHAN, J.] This writ petition has been filed for removal of encroachment said to have been committed by the 5th and 6th respondents herein on the public pathway in T.S No.368 falling within the third respondent Corporation limits. The petitioner had already given a representation dated 10.05.2017 in this regard.

2.The third respondent is directed to dispose of the said representation. If it is noticed that encroachments have been committed in the public pathway, it is the duty of the third respondent to cause their removal. The said exercise shall be carried out after due to notice to the encroachers, if any and after complying with due process of law. The entire exercise shall be completed within a period of 3 months from the date of receipt of a copy of this order.

3.This writ petition is disposed of with the above direction. No costs.
