In Crime No.145 of 2023. : Respondent/Complainant For Petitioners : Mr.M.Pitchai Muthu, Advocate For Respondent : Mr.M.Sakthi Kumar, Government Advocate (Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.145 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148 and 302 IPC, in Crime No.145 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity between the first accused and the defacto complainant, the first accused along with other accused, including the petitioners said to have abused the defacto complainant and also attacked him brutally https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.9086 of 2023 and caused injuries. Even though sufficient treatment, he was succumbed to the injuries. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the petitioners are innocents persons and they have not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) appearing for the State would submit that investigation is in progress.

5. Considering the seriousness and gravity of the offence alleged by the prosecution and also the fact that the investigation is in initial stage, this Court is not inclined to grant anticipatory bail to the petitioner at this point of time.
