Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Resolution No. 26 dated 26.12.2023 passed by the second respondent and quash the same as illegal and unconstitutional and consequently directing the second respondent to collect Rs 60/- per sq feet per day for the shop /tharaikadai situated at Nehru Anna Market, Darasuram from the petitioners herein as usual. ORDER

Heard the learned counsel appearing for the writ petitioners, the learned Standing Counsel appearing for the Kumbakonam Corporation and Thiru.R.Maheswaran, learned counsel appearing for the intervenor / contractor.

2.I do not want to go into the merits of the matter for the present. I place on record the stand of the respondents that license fee is collected 7/9

at the rate of Rs.3/- per Sq.ft. It is categorically asserted by the respondents that excess fee is not and will not be demanded from the market users. If there is any breach of this undertaking, it is always open to the individual concerned to move this Court again for relief. If any such case is listed before this Court, it will be taken as test case. 3.This writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
