Despite the notice being served on the counsel who appears for the respondent before the Sub Court, Coimbatore in H.M.O.P.No.113 of 2022 Page No. 1 of 4

as notice on the respondent was returned and the name being printed in the cause list today, there is no representation on behalf of the respondent. Hence, this case is taken up for final hearing.

2. Transfer Civil Miscellaneous Petition has been filed to transfer H.M.O.P.No.113 of 2022 from the Sub Court, Coimbatore to the Family Court, Pudukkottai.

3. In the affidavit filed in support the present Transfer Civil Miscellaneous Petition, the petitioner has stated that the petitioner is living with her mother aged about 75 years and that her father passed away. It is further stated that the petitioner depends on her brother who is employed in a private company at Pudukkottai and as the petitioner has no job, she depends on her brother for her daily meals and therefore cannot burden her brother.

4. It is further stated that the distance between the Coimbatore and the Pudukkottai is around 267 kms. and therefore, the petitioner will have to travel about 534 kms. for each and every hearing. Page No. 2 of 4

5. Being satisfied with the above reasons, I am inclined to allow this Transfer Civil Miscellaneous Petition. H.M.O.P.No.113 of 2022 pending on the file of the Sub Court, Coimbatore is directed to be transferred to the Family Court, Pudukkottai.

6. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No cost. Consequently, connected Miscellaneous Petition is closed.
