Devi ... 2nd Respondent/De-facto Complainant Prayer :- Criminal Original Petition is filed under Section 482 of Criminal Procedure code,to call for the records relating to CC.NO.140/2016 on the file of the Judicial Magistrate No.II, Kuzhithurai, Kanyakumari District and quash the same. ORDER:- This Criminal Original Petition coming on for hearing on this day under the caption for "Extension of time"and upon perusing the earlier order dated,02.11.2018 and the requisition letter submitted by the Judicial Magistrate No.II, Kuzhithurai vide the letter in D.No.781/2023 dated 05.06.2023,this Court made the following order:

"The learned Judicial Magistrate No.II, Kuzhithurai by his letter dated 05.06.2023 has sought extension of time to dispose of the case in C.C. No.140 of 2016.

2. This Court by an order dated 02.11.2018 in Crl.O.P.(MD)No.20046 of 2018 had directed the learned Judicial Magistrate No.II, Kuzhithurai to dispose of the case in C.C.No.140 of 2016 within a period of three months from the date of receipt of a copy of that order. In the letter it is stated that the learned Judicial Magistrate No.II, Kuzhithurai assumed charge of the post on 11.01.2021 and thereafter, on 21.04.2021, he was transferred to some other place and the II Additional District Munsif, Kuzhithurai hold the full Additional Charge of the post. He assumed charge on 20.03.2023, issued summons to the witnesses, examined PW1 and posted the case for further proceedings.

3. Considering the request made by the learned Judicial Magistrate No.II, Kuzhithurai and also considering the facts and circumstances of the case, time already granted by this Court to dispose the case in C.C. No.140 of 2016 is extended by another three months from the date of receipt of a copy of this order."
