: Respondents PRAYER: Writ Petition filed under Article 226 of Constitution of India for issuance of a Writ of Mandamus, directing the respondents to grant permission to conduct Vinayagar Chadurthi festival procession held on 14.09.2018 from Mahamaham Kulam to Palakkarai, Kumbakonam Town, Thanjavur District and complete the same within 06.00 P.M. on the basis of the petitioner's representation dated 06.08.2018.

ORDER

This Writ Petition has been filed for a direction to the respondents to grant permission to conduct Vinayagar Chadurthi festival procession on 14.09.2018 from Mahamaham Kulam to Palakkarai at Thanjavur District.

2.The learned counsel appearing for the petitioner submitted that this procession has been carried out for the last nineteen years and this year also the said procession is going to be conducted on 14.09.2018. Till now, there are no complaints or no https://hcservices.ecourts.gov.in/hcservices/

law and order problem has been created while conducting the procession. Therefore, the learned counsel appearing for the submitted that the respondents must be directed to permit the petitioner to conduct the procession on 14.09.2018. 3.The learned Government Advocate appearing for the respondents would submit that previous year also the petitioner has conducted the procession and in this regard there are no complaints or FIR against the petitioner. He further submitted that the third respondent will consider the representation given by the petitioner and grant permission for conducting the procession subject to the conditions that will be imposed by the third respondent. 4.

In view of the above submissions, this Writ Petition is disposed of with a direction to the third respondent to grant permission to the petitioner to conduct Vinayagar Chadurthi festival procession to be held on 14.09.2018 from Mahamaham Kulam to Palakkarai at Kumbakonam Taluk, Thanjavur District. It is made clear that entire procession must be completed by 06.00 P.M. on 14.09.2018. The third respondent is at liberty to impose any condition as may be necessary to ensure that the procession conducted in a peaceful manner without giving raise to any law and order problem. No costs.
