JUDGMENT

(Judgment of the Court was made by J.NISHA BANU, J.) This writ appeal is filed against the order dated 10.01.2025 made in W.P(MD)No.9751 of 2019.

2.

The appellant is a secondary grade teacher. She acquired a higher qualification of B.Sc(Electronics) and made a request for incentive increment. The said request was rejected by the respondents stating that there is no provision/guidelines to provide incentive increment for the qualification of B.Sc (Electronics). Challenging the said rejection, the appellant filed the writ petition. The Writ Court considering the submission made by the learned Government Advocate that the subject, B.Sc (Electronics) is not coming under the purview of the clarification issued by the Government for payment of incentive increment and relying upon the Division Bench judgment of this Court in the case of R.Sakthivel vs. Secretary to Government, Education Department (W.A(MD)No.910 of 2022, dated 24.08.2022), dismissed the writ petition. Aggrieved by the said order, the writ petitioner has filed this appeal. Page No.2 of 4

3.

Assailing the impugned order, though the appellant raised various grounds, we are not inclined to delve into the same. The appellant is a secondary grade teacher working in a Middle School taking classes for Standards VI to VIII and the qualification of B.Sc (Electronics) would not be beneficial to the students studying in middle school. Further, the qualification of B.Sc (Electronics) is not coming under the purview of the clarification issued by the Government enabling the respondents to provide incentive increment. Therefore, the respondents have rightly rejected the request of the appellant. We do not find any infirmity in the order passed by the learned Judge. 4.

Accordingly, the Writ Petition is dismissed. No costs. [J.N.B, J.] [S.S.Y, J.] 30.04.2025 Index : Yes / No bala Page No.3 of 4
