ORDER

This Writ Petition is filed for Writ of Mandamus, directing the first respondent to take action on the petitioner's representation dated 17.02.2025 for illegal auction sale of the Government property. 1/4

2. The contention of the petitioner is that the land in question was mortgaged to Indian Bank, Marthandam and the Bank has taken steps to sell the property in e-auction. The petitioner with an intention to purchase the property had enquired about the land. When he came to know that the Government has acquired a portion of the land, he contacted the Bank. However, the Bank has taken steps to sell the entire property including the land acquired by the Government. Hence the petitioner submitted a representation to take action against the Bank for selling the property which has been acquired by the Government. He has sent representation on 17.02.2025 to the first respondent. Since the same was not considered by the first respondent, the present writ petition came to be filed.

3. Learned Additional Government Pleader appearing for the respondent would submit that the representation of the petitioner will be considered by conducting enquiry.

4. Therefore, this Court directs the first respondent to issue notice to the petitioner as well as the Bank, thereafter conduct enquiry and pass orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
