This writ petition has been filed to call for the records relating to the impugned order issued by the 1st respondent herein in O.Mu.No. 2094/A4/2019 dated 08.08.2019, quash the same and direct the 2nd respondent herein to grant necessary permission to fill up the one sanctioned post of Secondary Grade Teacher by direct recruitment.
2. The learned counsel appearing for the petitioner would submit that the petitioner School has submitted a proposal to fill up the post of Secondary Grade Teacher to the first respondent and the same was returned vide the impugned order dated 08.08.2019 on the ground that 2/5
the Hon'ble Division Bench of this Court has granted interim order in W.A(MD).Nos.76 of 2018 etc., Subsequently, the writ appeals were disposed of. Hence, this Court may permit the petitioner to send a proposal to the respondents to fill up the post of Secondary Grade Teacher and if there is no legal impediment, the respondent may be directed to consider the same and pass appropriate orders.
3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
4. Considering the limited request made by the learned counsel appearing for the petitioner, this Court, without interfering with the impugned order passed by the 1st respondent, is inclined to grant liberty to the petitioner to send a fresh proposal to the respondents. If any such proposal is made, the respondents are directed to consider the proposal and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of the proposal. 3/5
5. Accordingly, this Writ Petition is disposed of. No costs. Connected miscellaneous petition is closed.
