Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to conclude the disciplinary proceedings issued against the petitioner by virtue of the charge memo in Na.Ka.No.254/2013 dated 21.06.2016 issued by the second respondent within a time stipulated by this Court.

ORDER

Mr.Raja Karthikeyan, learned Additional Government Pleader, takes notice for the first respondent. By consent, the Writ Petition is taken up for final disposal.

2. The petitioner, is working as Meter Reader in the office of the The Executive Officer, Killiyoor Panchayat, Tholayavattam Post, Kanyakumari District. It is stated that when he has suffered illness and admitted in the hospital on 02.05.2014, he was unable to attend his duty. After recovery from his illness, he has given a representation to the Second respondent. However, he was issued with the suspension order on 10.10.2014, stating that he has not submitted any medical records relating to his illness. Subsequently, a charge memo dated 21.06.2016 was issued calling upon the petitioner to submit his explanation. Denying the charges, the petitioner has also given his representation on 25.06.2016. no such order has been passed. Therefore, the petitioner is before this Court seeking early disposal of the disciplinary proceedings.

3. The learned Additional government pleader, on instructions, sought time for the respondents to pass orders in the pending disciplinary proceedings.

4. Therefore, the Second respondent is hereby directed to pass final order in the pending disciplinary proceedings within a period of three months from the date of receipt of copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
