ORDER

The writ petition has been filed for a mandamus to direct the 1st respondent ie., the Manager, United India Insurance Co. Ltd., Chennai to disburse the eligible amount of medical reimbursement as per the letter No.6051/2022/N2 dated 12.10.2022 of the Treasury Officer, District Treasury, Tuticorin based on the recommendation of the District Committee within a specific time frame that may be fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

3. By consent of both sides, the writ petition itself is taken up for final disposal.

4. The petitioner, who is a retired Government servant and a beneficiary under the NHIS, submitted that he was admitted in Velammal 2/5

Medical Hospital, Madurai for undergoing cardiac surgery on 27.02.2017 and discharged on 07.03.2017 and towards his cardiac surgery, he has incurred a sum of Rs.3,25,254/-. For his eye surgery also, he has incurred a sum of Rs.28,480. When the petitioner has made a claim for reimbursement to the respondents, the respondents have not considered the claim of the petitioner so far. Hence, the petitioner is before this Court.

Since the petitioner is a senior citizen and he has already suffered from serious health ailments, it is unfair on the part of the respondents to sit idle on the representation made by the petitioner without passing any orders. Further, the learned counsel for the petitioner submitted that as it appears from the proceedings of the 2nd respondent dated 15.07.2022 and 27.09.2022, the claim of the petitioner has been placed before the District Level Empowering committee and that the committee has also recommended the claim for reimbursement. In such case, it is obligatory on the part of the first respondent to pass appropriate orders as per the recommendation of the 2nd respondent within a period of three weeks from the date of receipt of a copy of this order. 3/5

6. With the above direction, this writ petition is disposed of. No costs.
