Respondents PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to direct the 1st respondent to transfer the investigation in Crime No.620 of 2020 dated 25.08.2020, on the file of the 2nd and 3rd respondents to any other investigation officer within the 1st respondent jurisdiction to conduct the investigation in the manner known to law.

Heard the learned counsel on either side.

2.The petitioner seeks transfer of investigation. 3.I carefully went through the contents of the petition. I am of the view that no case for transfer of investigation has been made out. Even according to the petitioner, the occurrence had taken place on 25.08.2020. On the very same date, Crime No.620 of 2020 was registered by the third respondent. There is nothing on record to show that the investigation is not being done on proper lines. In fact in a case of this nature where everything rests on testimony of the petitioner, there is no possibility of even a derailment of the investigation. This is not a case in which investigation deserves to be transferred. However, the learned Additional Public Prosecutor appearing for the respondents states https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.10954 of 2020 that within a period of three months the final report will be filed. 4.Recording the said submission, I direct the second respondent to file the final report within a period of three months from the date of receipt of a copy of this order. The criminal original petition is disposed of with the aforesaid direction.
