PRAYER :- For Bail in Crime No.299 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on 25.12.2022 for the offence under section 8(C) r/w 20(b) (ii)(C), 25, 27(A), 29(1) of NDPS Act in Crime No.299 of 2022 on the file of the respondent police seeks bail.

2.The case of the prosecution is that on 25.12.2022, based on the secret information, the respondent police went to the place of the occurrence and intercepted a car bearing Reg.No.TN 09 BP 8442. On search, it was found that the accused persons were in illegal possession of 22.300 kgs of ganja. Hence the case. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD)No.9014 of 2023 3.Heard both sides and perused the materials available on record including the First Information Report. 6.It is seen that there are totally four accused in this case, in which, the petitioner herein is arrayed as A4. All the accused persons were found in conscious and constructive possession of 22.300 kgs of ganja, which is commercial quantity. That apart, the petitioner also involved in similar previous case. Hence, the petitioner failed to fulfill the twin conditions as contemplated under Section 37 of NDPS Act. Thereore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
