.. Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the respondents 2 and 3 to provide police protection to the life and limb of the petitioner and his family members from the respondents 4 to 6.

ORDER

This petition is filed seeking police protection, on the basis of the representation dated 22.07.2021.

2.When the matter was taken up for hearing on 05.08.2021, the learned Additional Public Prosecutor submitted that the enquiry is pending and the case was adjourned to 03.09.2021. On 03.09.2021, the learned Additional Public Prosecutor submitted that CSR was registered and the petitioner did not cooperate to complete the enquiry. So, a direction was issued to the petitioner to appear before the Enquiry Officer. However, the learned counsel appearing 1/3

for the petitioner submitted that the petitioner appeared before the Enquiry Officer twice and he is also ready to appear before the Enquiry Officer at any time. On that ground, to intimate the outcome of the enquiry, the matter has been listed today. 3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 would submit that the enquiry is still pending and has circulated the copies of the statements given by this petitioner as well as the respondents 4 and 5.

4.It appears that both parties appeared before the Enquiry Officer and the 4th respondent herein has given a statement to the effect that he will not make any trouble to the petitioner and similarly, the 5th respondent herein has also given a statement to the effect that except the suit that is pending between him and this petitioner, no other trouble was made to this petitioner and also undertook that he will not give any trouble. This petitioner also gave a statement to the effect that the 4th respondent herein did not make any trouble and one Marimuthu, Revenue Inspector and the 5th respondent herein are making trouble.

5.In the facts and circumstances of the case, no police protection is required and there is no life threat to the petitioner also. If any trouble arises in future in violation of the undertaking given by the aforesaid persons, the petitioner is at liberty to workout his remedy before the appropriate forum through appropriate proceedings.

6.With the aforesaid liberty, this petition stands disposed of.
