ORDER
The petitioner has approached this Court that his complaint dated 02.10.2024 has not been attended by the 2nd respondent and therefore, he seeks a direction to the 2nd respondent to initiate necessary action on his complaint dated 02.10.2024.

Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents, submits that the petitioner's complaint was duly attended by the 3rd respondent by treating the same as petition enquiry in CSR No.763 of 2024 on the file of the Tiruchendur Police Station on 02.10.2024. Considering the volume of amount involved in the petitioner's complaint, the same was forwarded to the District Crime Branch, Thoothukudi. 2/6
Since the petition enquiry in CSR No.763 of 2024 was forwarded to the District Crime Branch, Thoothukudi, the 3rd respondent, namely, the Inspector of Police, Tiruchendur Police Station, has closed the petitioner's complaint.

The learned Additional Public Prosecutor further submits that the 2nd respondent, namely, the Inspector of Police, District Crime Branch, Thoothukudi, has treated the same as current paper enquiry and they have also issued summons to the petitioner on 25.05.2025 and 28.05.2025, however, the petitioner did not appear for enquiry. Therefore, the enquiry has been adjourned to 05.06.2025 and summon has also been issued to the petitioner.

Considering the submissions made by the learned Additional Public Prosecutor, this Writ Petition is disposed of with a direction to the petitioner to appear before the 2nd respondent, namely, the Inspector of Police, District Crime Branch, Thoothukudi, on 05.06.2025 along with the required documents. 3/6
The 2nd respondent shall ascertain as to whether any prima facie case is made out and thereafter, proceed with in accordance with law either by registering a case or closing the complaint. However, a decision has to be taken within a period of four weeks from the date of receipt of a copy of this order. No costs. 02.06.2025 Index : Yes / No.
