CORAM

THE HONOURABLE MR.JUSTICE K.MURALI SHANKAR Saravanan ... Petitioner Vs.

The State of Tamil Nadu represented by The Inspector of Police, Avanyapuram Police Station, Madurai District.

(Crime No.51 of 2025) ... Respondent PRAYER : Criminal Revision Case filed under Section 438 r/w 442 B.N.S.S., to set aside and modify the condition No.i) of the impugned order passed in Crl.M.P.No.1815 of 2025 by the file of learned Judicial Magistrate No.VI, Madurai by modifying the condition to execute bond for a sum of Rs.12,00,000/- for the petitioner with 2 sureties like sum. For Petitioner : Mr.V.Sukumar For Respondent : Mrs.M.Aasha Government Advocate (Crl. Side)

ORDER

The Criminal Revision is directed against the condition No.(i) 1/4

imposed in Crl.M.P.No.1815 of 2025 dated 03.04.2025 on the file of the Judicial Magistrate No.VI, Madurai, wherein, the petitioner was directed to execute a bond for Rs.12 lakhs for himself with 2 solvent sureties for like sum.

2. It is evident from the records that the respondent police has seized a Honda Ameze Car bearing Registration No.TN-63-CZ-8515 in connection with the case in Crime No.51 of 2025 for the offences under Sections 61(2), 318(4) and 204 BNS and the said property was produced before the concerned Court and the same was received and remanded in R.P.R.No.79 of 2025.

3. It is not in dispute that the petitioner has approached the learned Judicial Magistrate No.VI, Madurai, seeking interim custody of the said vehicle and the learned Magistrate, taking note of the objections of the prosecution, has passed the impugned order dated 03.04.2025 granting interim custody by imposing the impugned condition.

4. The learned Government Advocate (Criminal Side) appearing 2/4

for the respondent would submit that the value of the vehicle would be Rs.8 to R.10 lakhs.

5. Considering the above, the condition No.(i) imposed by the learned Magistrate seems to be onerous and the said condition is to be modified. Accordingly, the order of the learned Judicial Magistrate No.VI, Madurai, made in Crl.M.P.No.1815 of 2025, dated 03.04.2025 is modified in respect of the condition No.(i) alone and it is modified to the effect that the petitioner is directed to execute a bond for a sum of Rs.4,00,000/- (Rupees Four Lakhs only) with two sureties for a likesum to the satisfaction of the learned Judicial Magistrate No.VI, Madurai. In respect of other conditions, the order of the learned Judicial Magistrate No.VI, Madurai, shall remain unaltered.

6. With the above modification, this Criminal Revision Case stands disposed of. No costs.
