RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the sentence imposed on the petitioner by the judgement dated 28/06/2018 passed in Special Case No.64/2011 on the file of the Special Court for the trial of cases under the Prevention of Corruption Act, Madurai and enlarge the petitioner on bail pending disposal of the above Crl.A.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.A.R.KANNAPPAN, Advocate for the petitioner and of MR.A.ROBINSON, Government Advocate (Crl.Side)on behalf of the Respondent, while admitting the CRL A., the court made the following order:- Heard the learned counsel appearing for the appellant and the learned Government Advocate (Crl.side) appearing for the respondent. 2.The appellant herein has been tried in Special Case No.64 of 2011, found guilty under Section 7 and 13(2) r/w 13(1)(d) of Prevention of Corruption Act and sentenced to undergo 2 years simple imprisonment and to pay a fine fo Rs.1,000/- in default to undergo 3 months simple imprisonment, for each of the said offence. The time for surrender has now been expired. However, it appears that the appellant herein has not surrendered to undergo the remaining period of sentence. The grounds raised in the appeal memorandum does not make out any case in favour of the appellant/accused. The reason stated in the petition is not convincing.

3.Therefore, the application to suspend the sentence is dismissed.
