file of the 2nd respondent rejecting the petitioner's application for issuance of legal heir certificate made through application No.TN-7202502182712 dated 18.02.2025 and quash the same and consequently direct the 2nd respondent to issue a legal heirship certicate to the effect that petitioner is the legal heir of the deceased Meenambal, D/o Ayyakannu, who died on 08.12.2024 within such time as may be fixed by this Court.

ORDER
This Petition is disposed of at the time of admission, after hearing the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.
2. This Writ Petition has been filed challenging the order of the second respondent, dated 27.02.2025, whereby the request made by the petitioner for the issuance of a legal heir certificate in respect of his deceased wife, late Meenambal, was rejected.

3. The petitioner had applied for a legal heir certificate for the deceased Meenambal, who is stated to be his second wife, during the subsistence of his marriage with one Gayathri. It is also seen that H.M.O.P. No.6 of 2022 was pending on the file of the Sub Court, Aranthangi.
4. During the subsistence of the first marriage, the question of contracting second marriage does not arise. Therefore, the legal heir certificate to recognise a bigamous relationship as a valid marriage does not arise. Hence, this Writ Petition is liable to be dismissed and is accordingly dismissed.
