RESPONDENT/ COMPLAINANT For Petitioner : MR.R.MURUGAN Advocate For Respondent : MR.M.ASOKAN Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406, 417, 420, 468 and 471 IPC in Crime No.150 of 2018, on the file of the respondent police, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the State. 3.This Court called upon the concerned Enforcement Officer to be present.

4. Mr.V.S.Karthick, learned standing counsel for Provident Fund submits that the petitioner has to pay a sum of Rs.9,24,447/-, which represents the interest component as per Section 7 Q of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952.

5. At this stage, the learned counsel appearing for the petitioner submits that he would remit a sum of Rs.3,00,000/- within a period of two months from the date of receipt of a copy of this order.

6. Subject to the condition that the petitioner shall pay a sum of Rs.3,00,000/- [Rupees Three Lakhs only] directly to the Employees Provident Funds Department, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Trichy, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
