O R D E R

This Writ Petition has been filed seeking a direction to the respondents to remove a road and electricity posts laid in the petitioner's properties in Survey Nos.406/4B and 406/6A, Kottur Village, Nilakottai Taluk.

2. It is the case of the petitioner that the respondent Nos.3 and 4 laid a road and erected posts in the petitioner's property. Hence, the petitioner made a representation to the first respondent on 29.11.2021 and the District Collector issued proceedings to the Tahsildar to take action on the petitioner's representation. Since the same has not been considered till date, the petitioner has approached this Court.

3. The learned Special Government Pleader appearing for respondent Nos.1 to 3 would submit that the request of the petitioner would be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the respondent Nos.3 and 4 to consider the request of the petitioner by taking into account the proceedings of the first respondent dated 06.12.2021 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
