PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order of the 3rd respondent in TR 2024/103/26/221973/TR dated 09.01.2024 and the consequential patta issued in the name of the respondents No.4 to 7 vide patta No.1036 in S.No.89/5, Kumaralingapuram Village, Virudhunagar Taluk, Virudhunagar District, and quash the same as illegal and to restore the same in name of the petitioner.

ORDER
The petitioner challenges the order of the third respondent, dated 09.01.2024, regarding mutation effected without notice to the petitioner. 2.The learned counsel for the petitioner would invite my attention to the impugned order to patta No.984, which also pertains to very same survey No. 89/5. However, in the impugned order dated 09.01.2024, there is no reference to the name of the writ petitioner, though the patta has already been issued as early as on 27.01.2023. 2/4
3. In view of the above, the petitioner ought to have been put on notice before the impugned order came to be passed on 09.01.2024. On this limited ground, the writ petition is allowed and the impugned order is set aside. The matter is remitted to the third respondent for conducting fresh enquiry, on the application of Seethalakshmi dated 28.12.2023, after giving an opportunity to her as well as the petitioner and pass final orders on merits accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
