ORDER : The Court Made the following order :- The petitioner is in judicial custody since 19.07.2018 for the offences punishable under Sections 8 (c) r/w. 20(b) (ii), (c) of NDPS Act, in Crime No.1078 of 2018, on the file of the respondent police. He seeks bail. The petitioner is arrayed as accused No.4. 2.The case of the prosecution is that on 19.07.2018, when the de-facto complainant was conducting usual checkup, at that time, he came to know that the accused persons were having two bags of Kanja each containing 10.500kg. Hence, the respondent police registered a case against the petitioner herein.

4.The learned counsel appearing for the petitioner would submit that the quantity involved in this case is a small quantity. 5.The learned Additional Public Prosecutor appearing for the respondent police would submit that the investigation is pending. He would further submit that there was no previous case pending against the petitioner herein.

6.Considering the above facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Principal Special Court for EC & NDPS Act Cases, Madurai. (ii)the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders;
