For Respondent : Mr.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.7/2019 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 406 of IPC and Section 4 of Dowry Prohibition Act, 1961, in Crime No.7 of 2019, on the file of the respondent police, seeks anticipatory bail.

2.On the earlier occasion, an undertaking has been made by the petitioner that he is ready to pay a sum of Rs.5,00,000/-(Rupees Five Lakhs only) to the defacto complainant on that ground, the matter is adjourned today.

3.Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that out of the Court, compromise reached between the parties and now the defacto complainant agreed to receive a sum of Rs.3,00,000(Rupees Three Lakhs Only) and also submitted that the defacto complainant married another man on 26.12.2021.

4. In view of the subsequent development, this Court is inclined to grant bail to the petitioner, however, with stringent conditions.

No.11486 of 2022 5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or his appearance, before the learned Judicial Magistrate Court, Tiruchendur, and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only)each, with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police on every Saturday at 10.30 am until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
