PRAYER :-For Bail in Crime No.206 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/ Accused, who was arrested on 22.04.2022 for the alleged offences under Sections 302 and 309 of IPC, in Crime No.206 of 2022 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the marriage between the deceased and the petitioner took place 9 months prior to the date of occurrence. On 11.04.2022, the defacto complainant received an information from the petitioner's neighbour that the petitioner jumped from the terrace. On getting information, she went to the occurrence place and found the injured/petitioner. He further stated that on the previous day at about 9.30 p.m the petitioner and the deceased came to their house and right from that time there was a frequent quarrel between them. On 11.04.2022, she went to shop.

While she returning home, she found that the deceased died with knife injury. On enquiry, the petitioner stated that because of the frequent quarrel that took place between them, the petitioner attacked the deceased with knife.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 22.04.2022.

4. The respondent police is present before this Court and he submitted that because of the unwilling on the part of the deceased for shifting to Bangalore, frequent quarrel arose between them. At one point of time, the accused person went to Bangalore and stayed for same time and also invited the deceased to Chennai. Because of that issue, quarrel arose between them out of sudden fight, the petitioner attacked the deceased with knife. He would further submit that the investigation has been completed and the final report is made ready.

5.Heard the learned Government Advocate(Crl.side) appearing for the respondent police.

6. On perusal of records, it appears that there was no previous motive and because of sudden quarrel between them, the occurrence is said to have taken place.

7.Considering the facts and circumstances of this case and considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions. 8.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Dindigul District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 06/07/2022 / TRUE COPY / 06/07/2022 Sub-Assistant Registrar (C.S.)
