ORDER
This petition is filed to direct the learned Judicial Magistrate, Vadipatti to expedite the trial proceedings in CC No.33 of 2020, within the stipulated period.
2.The grievance of the petitioner is that the crime is of the year 2015, which was registered for the offences punishable under Sections 294(b), 406, 420 IPC, on the basis of the complaint given by him on 19.07.2015. After lapse of 4 years, the Final Report came to be filed before the concerned Court, which was also taken on file in CC No.33 of 2020 in the year 2020. Even then, the respondent police has not taken any steps to secure the accused and conduct the trial. Hence, this petition.
3.The learned counsel for the petitioner would submit that the petitioner is aged about 58 years and he is a senior citizen. Therefore, direction may be issued to the concerned judge to expedite the trial.
4.The learned Additional Public Prosecutor would submit that the case is posted on 26.10.2021 for the appearance of the accused.
5.Considering the oldness of the crime and also considering the submission made by the learned counsel for the petitioner, the learned Judicial Magistrate, Vadipatti is directed https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.10695 of 2021 to expedite the trial and dispose of the case in CC No.33 of 2020, within a period of six months from the date of receipt of a copy of this order, on merits and in accordance with law. After disposal of the case, compliance report must be submitted to the Registry of this Court.
6.With the above direction, this Criminal Original Petition is disposed of.
