PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.45 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 506(i) IPC in Crime No.45 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is a JCB operator and he was cleaned the village tunnel and removed the palm trees, which were standing in the field of the defacto complainant. When the defacto complainant asked the petitioner to take the leaves of palm trees, the petitioner refused to give and abused him in filthy language and also attacked him with iron rod. Hence, the case.

CRL OP(MD)No.9831 of 2023 3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner is having four previous cases and this is second petition for anticipatory bail. 5.In view of the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail. Accordingly, this criminal original petition is dismissed.
