ORDER : The Court made the following order :- The petitioner/sole accused, who apprehend arrest at the hands of the respondent Police for the offences punishable under Sections 5(l) and 6 of POCSO Act in Crime No.205 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner on the false promise of marrying the victim girl had committed penetrative sexual assault on her and thereafter refused to marry her. Hence, the complaint.

3. Heard both side and perused the materials available on record including the First Information Report and the statement of the victim recorded under section 164 of Cr.P.C. https://www.mhc.tn.gov.in/judis 1/2

4. This is the second application for anticipatory bail and the earlier application for anticipatory bail was dismissed by this Court on 05.04.2023 in Crl.O.P(MD) No.6286 of 2023 and there is no change in circumstances of the case to consider the present anticipatory bail petition even after dismissal of the petition, hence this court is not inclined to grant anticipatory bail to the petitioner.
