ORDER : The Court made the following order :- The petitioner/A10, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 109, 147, 148, 294(b), 302, 324, 341, 342 and 506(ii) IPC in Crime No.24 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution as per the de-facto complainant is that due to previous enmity, on 29.01.2023 at about 4.30 p.m., the son of the defacto complainant, namely, Venkatesh and one Vikram were standing and talking in front of Paravai, Karuppasamy Kovil. At that time, the petitioner said to have given weapon to one Sankarlal to attack the son of the defacto complainant, namely, Venkatesh, who succumbed to injury. CRL OP(MD). No.9292 of 2023 3.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor for the respondent would submit that the allegation against this petitioner is that she has provided weapon to the said Sankarlal, who caused injury to the deceased and this is the 3rd anticipatory bail application and the earlier applications were dismissed by this Court. Further, there is no change in circumstances. Hence, he would object for grant of anticipatory bail.
4.Considering the fact that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
