ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 03.03.2023 for the offence under section 174 Cr.P.C. altered into Section 302 IPC in Crime No.68 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the deceased is the paramour of the petitioner. Suspecting the character of the deceased, the petitioner assaulted her and murdered her. Hence, the complaint.
3. No doubt, the petitioner's earlier application for bail in Crl.O.P.(MD)No.8461 of 2023 was ordered to be dismissed by this Court, vide order, dated 04.05.2023.

4. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in the above case and that the petitioner is in judicial custody from 03.03.2023.
5. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having two previous cases, in which, one case was registered for the offence under Section 302 IPC. He would further submit that investigation is still pending.
6. Considering the above facts and circumstances and also the fact that investigation is not yet completed and that there is no change in circumstances, since the dismissal of the earlier petition, this Court is not inclined to grant bail to the petitioner
