ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 149, 114, 323, 324, 506(ii) and 302 IPC in Crime No.597 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution as per the de-facto complainant, is that due to previous enmity between the parties, on 13.12.2021 at about 07.30 p.m., the petitioner came in a two wheeler along with her husband and other accused came to an auto rickshaw and made quarrel with the deceased family and attacked the deceased with crowbar and stick on his chest. As a result, he succumbed to the injury. Hence, the complaint.

3.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor for the respondent would submit that https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.9144 of 2023 this is the petitioner's fifth application for anticipatory bail and the earlier applications for anticipatory bail were dismissed by this Court. He would further submit that there is no change of circumstances in this case and hence, he would object for grant of anticipatory bail.

4.Taking into consideration the fact that there is no change in circumstances, since the dismissal of the earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner. 5.Accordingly, this Criminal Original Petition is dismissed. sd/- 18/05/2023 / TRUE COPY / /05/2023 Sub-Assistant Registrar (C.S.)
