PRAYER :- For Bail in Crime No.40 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 04.03.2023 for the offence under section 8(c), 20(b)(ii)(c) and 25 of NDPS Act, 1985 in Crime No.40 of 2023 on the file of the respondent police seeks bail.

2.The case of the prosecution is that on 04.03.2023, at 03.30 pm., based on the secret information, the respondent police went to the spot. At that time, two wheeler bearing Reg.No.TN 45 BW 3353, wherein the petitioner along with A1 have travelled and they were intercepted by the police team and on enquiry, it revealed that they were in possession of 22 kgs of ganja. Hence the case. 3.Heard both sides and perused the materials available on record including the First Information Report. 4.It is seen that this second bail petition and previous petition for bail was dismissed on 17.04.2023. CRL OP(MD)No.9304 of 2023 in circumstances. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
