PRAYER :- For Bail in Crime No.115 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 09.03.2023 for the offences under Sections 294(b), 307 and 109 of IPC in Crime No.115 of 2023 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that in continuation to the property dispute on 08.03.2023 at about 09.30 a.m., the husband of the de-facto complainant received a phone call that somebody is trying to make tin shed in place belonging to him, hence, he rushed o the spot. On the same day at about 10.30 a.m., the de-facto complainant received a phone call that her husband was stabbed and she rushed to the hospital and came to know the fact from her husband that on the instigation of A1, A2 to A4 who are working under A1 with an intention to cause death attacked the injured with knife on his right side chest and also attacked him on his left chest and left side hip and caused injuries. CRL OP(MD). No.9246 of 2023 3.Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) would submit that this is the petitioner's third application for bail and the earlier applications for bail in Crl.O.P.(MD)Nos.6808 and 8351 of 2023 were dismissed on 19.04.2023 and 28.04.2023. He would further submit that there is no change of circumstances in this case and hence, he would object for grant of bail.

4.Taking into consideration the fact that there is no change in circumstances, since the dismissal of the earlier petitions, this Court is not inclined to grant bail to the petitioner. 5.In the result, this Criminal Original Petition is dismissed. sd/- 18/05/2023 / TRUE COPY / /05/2023 Sub-Assistant Registrar (C.S.)
